India’s tax rules for NRIs can look simple on paper, but one wrong day-count, TDS rate or bank account entry can trigger notices and blocked refunds. The NRI income tax rules 2026 continue to tax non-residents mainly on income earned, received or deemed to arise in India.

For NRIs, the key areas to watch are residential status, Indian-source income, TDS (tax deducted at source), ITR filing, DTAA (Double Taxation Avoidance Agreement) relief and FEMA (Foreign Exchange Management Act) compliance. Here is a practical guide for Indian taxpayers living abroad.

NRI Income Tax Rules 2026: Residential Status Comes First

Your Indian tax liability depends on your residential status under the Income-tax law. You are generally treated as a resident if you stay in India for 182 days or more in a financial year. You may also become resident if you stay for 60 days or more in that year and 365 days or more in the preceding four years.

However, exceptions apply for Indian citizens leaving India for employment, crew members of Indian ships and NRIs or Persons of Indian Origin visiting India. In many such cases, the 60-day test is relaxed to 182 days. For high-income Indian citizens with Indian-source income above ₹15 lakh, the 120-day rule and RNOR category need closer review.

RNOR means Resident but Not Ordinarily Resident. This status often helps returning NRIs because foreign income may remain outside Indian tax unless it is from a business controlled from India or a profession set up in India.

  • NRI, taxed only on Indian-source income
  • RNOR, taxed on Indian income and certain foreign income linked to India
  • Resident, taxed on global income

NRIs should maintain passport copies, travel dates and immigration records. These documents become important if the Income Tax Department questions residential status.

NRI Income Tax Rules 2026: What Income Is Taxable in India

Under the NRI income tax rules 2026, India taxes income that accrues, arises, is received or is deemed to be received in India. Foreign salary for work performed outside India is usually not taxable for an NRI.

Taxable Indian income commonly includes salary for services rendered in India, rent from Indian property, capital gains from Indian shares, mutual funds or real estate, NRO savings and FD interest, dividends from Indian companies and professional fees from Indian clients.

Interest on NRE and FCNR deposits is generally exempt in India, subject to conditions. In contrast, NRO interest is taxable and banks usually deduct TDS at 30% plus cess. This is one of the most common refund situations for NRIs because the actual tax liability may be lower after slab benefits or DTAA relief.

For Indian investments, taxation depends on asset type and holding period. Listed equity shares and equity-oriented mutual funds held for more than 12 months are treated as long-term capital assets. Long-term capital gains above the applicable exemption limit are taxed at the prescribed rate. Short-term gains on listed equity are taxed at a higher special rate. Property becomes long-term if held for more than 24 months.

NRIs selling Indian property should be extra careful. Buyers often deduct 1% TDS by mistake, which applies to resident sellers. For NRI sellers, TDS is generally under Section 195 and can be much higher. A lower deduction certificate from the tax department may help reduce excess TDS.

NRI TDS and ITR Filing Rules for 2026

TDS is strict for NRIs because the payer has a higher compliance duty. Rent, NRO interest, dividends, property sale payments and capital gains payouts may attract TDS from the first rupee, depending on the income type.

Most NRIs must file an income tax return if their Indian income exceeds the basic exemption limit, if they have taxable capital gains, or if they want to claim a refund of excess TDS. Even where total income is low, filing ITR is often useful because banks, property buyers and mutual fund platforms may have deducted excess tax.

Most NRIs use ITR-2 for income from salary, house property, capital gains, dividends and interest. ITR-3 applies if the NRI has business or professional income in India. ITR-1 and ITR-4 are generally not available to NRIs.

Before filing, NRIs should check Form 26AS and AIS (Annual Information Statement). These show TDS, interest, dividends, securities transactions and other reported financial data. Any mismatch can delay refund processing.

Key documents to keep ready include:

  • PAN and active income tax portal login
  • Passport and India stay details
  • NRO, NRE and FCNR interest certificates
  • Rent agreements and tenant TDS details
  • Capital gains statements from broker, MF platform or RTA
  • Property purchase and sale deeds, if applicable
  • Tax Residency Certificate and Form 10F for DTAA claims
  • Pre-validated NRO bank account for refund credit

NRIs should also note that the Section 87A rebate, which benefits resident individuals under specified conditions, is not generally available to non-residents.

NRI DTAA Benefits and FEMA Compliance in 2026

DTAA helps avoid double taxation when the same income is taxed in India and the country of residence. India has tax treaties with many countries, including the US, UK, UAE, Singapore, Canada and Australia.

DTAA can reduce TDS on interest, dividends, royalties or fees for technical services, depending on the treaty. To claim treaty benefits, NRIs usually need a Tax Residency Certificate from the foreign country and Form 10F. For foreign tax credit claims, Form 67 and supporting proof of foreign taxes paid are important.

FEMA compliance is equally important. Indian income such as rent, pension, dividends and sale proceeds should normally be credited to an NRO account. NRE accounts are meant for foreign earnings remitted to India. Mixing Indian income with NRE funds can create compliance issues.

NRO funds are repatriable within prescribed limits, typically up to USD 1 million per financial year after taxes and documentation. NRE and FCNR balances are generally freely repatriable.

What NRI Income Tax Rules 2026 Mean for You

The main takeaway is simple. NRIs are not taxed in India on global income merely because they hold an Indian passport. India taxes them mainly on Indian-source income, subject to residential status and treaty relief.

Still, compliance needs discipline. Track your India stay, separate NRE and NRO funds, verify TDS in Form 26AS, claim DTAA benefits with proper documents and file the correct ITR form on time.
